ESSENTIAL AND NON ESSENTIAL FORMS

Clayton ordered the forms online before I emigrated to the US, you can order the forms online These are the forms that are essential in filling for your Adjustment of Status:-

  • I-485 Notice :- this is a checklist of what documents to include in your application. Please be sure to check with your local INS office or check with the INS website. Some things have changed since we received our packet information.
  • Form I-485 : - Application to register permanent residence, or Adjust Status. This is the main form that the alien has to fill out, for more information on how to fill this form out please click here.
  • Form G-325A :- Biographic Information, this is the same form you filled out for your I-129f Petition. Only the Non-US files this form this time.
  • Form I-864 Affidavit of support : - In some States and INS offices they don't require this form with your application, some local INS offices like to have them handed in at the AOS Interview. Please check with your local INS office before you send your application off. In our Case we have to send the Affidavit of support off with our Application.

    This form has a little more detail to the I-134 Form, each sponsor has to provide a letter from their employer stating salary hours etc. Plus 3yrs of tax returns, I was told by our local INS office to go to the IRS office and get a printout of the last 3yrs. The Sponsor has to be earning 125% above the poverty line for the persons within the household. If the sponsor does not meet the requirements, it is recommended for you to have a co-sponsor in which they file the Form I-864A Contract between sponsor and household member.

  • Form I-864A :- Contract between sponsor and household member. This is the form you fill our if you live with your Co-Sponsor.
  • Form I-765 :- Application for Employment Authorization. This form is to apply for a work permit, I didn't fill this form, seeming it cost $120 to file. You need to file this form with your AOS Application
  • Form I-131 :- Application for Travel Document. This form is to apply for advance parole, the Non US Citizen can't leave the United States without filling for Advance parole (Form I-131) This form costs $110 to file, we didn't file this form ether.
  • Form FC-485 :- Fingerprint Instructions For All Immigration Benefit Applicants. Do Not Submit a completed fingerprint card (FD-258) with your application. Please include a $75 application fee, with your AOS Application.

With our application we received many other forms that we didn't need to file I did some research online then phoned my local INS office to double check what we did and didn't need to file with my AOS Application.

  • Supplement A Form I-485 :- When I saw the fee for this form I nearly fainted, this form costs $1,000 to file. I phoned the INS office to find out if K-1 Holders have to file this form, and luckily they don't have to file this form.
  • Form I-693 :- Medical Examination of Aliens seeking Adjustment of Status. K-1 Holders don't file this form, Instructions stated on the I-485 Form...

    '(Fiancée): If you are a K-1 Fiancée or a K-2 dependent who had a medical exam within the past year as required for the nonimmigrant fiancée visa, you only need to submit a vaccination supplement not the entire medical report. You may include the vaccination supplement with your adjustment of status application.'
